Identity theft crimes first began making their appearance into our everyday language in the 1990's, when the U.S. Congress passed the Identity Theft and Assumption Deterrence Act (ITADA), potentially making credit card fraud, mortgage fraud, check theft, and using someone else's Social Security number a federal crime. Unfortunately, however, provisions of the ITADA are often misinterpreted by District Attorneys and prosecutors, leading to vague and unsubstantiated criminal charges.
